It's judicial calvinball. They get away with it through procedural posturing and how they grant cert to particular questions. They specifically avoided granting cert on parental rights to the supportive parents of trans youth but acted on an emergency basis for transphobic parents.
This court specifically avoided bringing up challenges on bans for gender affirming care for trans youth on parental rights grounds so they can weaponize parental rights against trans youth while stripping them from the supportive parents of trans youth. It's obscene.

On January 10, 2026, while driving back to work after getting lunch with his father and cousin, a car quickly passed O., sped up, then stopped in front of him. (Id. ¶ 3.) A few men in civilian clothes stepped out of the car and asked for his identification. (Id.) The men threatened O.—if he did not get out of the car, they would force him out. (Id.) O. exited the car and was told he was under arrest. (Id.) The men handcuffed him and did not allow him to bring his phone. (Id.) O. felt like he was being kidnapped. (Id.) The men detained O., his father, and his cousin, taking them all to Whipple. (Id. ¶ 4.) At Whipple, there was “food scattered on the floor, the floor was sticky with mud, and everything stuck to your shoes.” (Id. ¶ 5.) The space was so cramped that sometimes there was no space to sit on the floor. (Id.)

Even this is a massive understatement of the actual costs, since all of those things require advance planning, paperwork, and (in some cases) scheduling document retrievals (often only possible during work hours). The cost doesn't have to be high in dollars to be a prohibitive tax on voters.
In other words, the backsliding is real and serious. This is perhaps the most unfavorable that the public has been toward trans rights in quite some time. Republicans have successfully and effectively exploited several flashpoint issues, like sports, in order to shift public opinion in their direction, while progressives have been unable to effectively muster persuasive arguments. Some of this may be down to an unwillingness to even entertain a debate, in an unsuccessful effort to maintain a unified front. Progressive activists and organizations have often been confrontational when challenged with dissenting views, leading critics to claim that these tactics left little room for actual debate. The net result, however, is the worst-case scenario for progressives and trans individuals alike, as a previously sympathetic public’s support of trans rights has completely unraveled over the last decade.
The anti-trans side made bomb threats to children's hospitals. They spent a billion dollars messaging this over the last 7 years while the Dems mostly stayed silent or ducked away. But somehow, they always seem to blame trans people for their own persecution.
