The respondents highlighted the importance of open justice and how justice must be seen to be done. Accessibility of the law and public understanding of the justice system was seen by many as important principles which underpin the rule of law. They also contributed to topics such as accessing courts and tribunals; remote observation; broadcasting; single justice procedure; access to court documents and information, and data access and reuse.

This report summarises the responses to the call for evidence. The insights shared by respondents will inform the Department's policies to modernise and improve the transparency of the justice system, ensuring it upholds the rule of law.

"It is extremely concerning that the quarterly criminal court statistics have not been published for the first six months of the year," says Nick Emmerson, Law Society of England and Wales president.

"You cannot solve a problem if you cannot measure it. Without robust, rigorous and comprehensive data collection the government cannot hope to understand what is going on in our courts or be able to address the huge backlogs.

"Victims and defendants spend years in limbo waiting for justice as the backlogs continue to grow. The misery faced by all those caught up in these unacceptable delays will not go away unless the government fixes this data challenge and begins to rebuild the foundations of this vital public service."

"For those where we were not at fault, this was primarily due to authorised third parties uploading information incorrectly onto our system, following the introduction of new case management systems such as the Common Platform," said the report.

"We continue to engage with all parties to put measures in place to mitigate these issues. For example we have implemented several IT solutions to minimise the impact, including the ability of our Service Centre staff to remove incorrect documentation uploaded by professional users."
