We held seven evidence sessions and received 21 written submissions, but were not able to hold a final evidence session with the then-Minister and to produce a report before the summer recess, given the timing of the General Election. Now, the political context has changed significantly — in particular, the previous Government's Data Protection and Digital Information Bill (DPDI Bill), which was the focus of much of our evidence, fell at dissolution. Nevertheless, the June 2025 expiry of the UK's EU adequacy status still looms, and the Government plans a Digital Information and Smart Data Bill covering some of the same issues as its predecessor’s DPDI Bill.

HELLO DATA MY OLD FRIEND: Britain's big data protection reform is back. According to serveral people briefing on the government's timeline, ministers are set to re-introduce the new look Digital Information and Smart Data Bill towards the end of next week, with Oct. 24 being earmarked by two of those people as the most likely date. We're told the new government is keen to tout the bill as a much needed economy booster, while one person briefed told us it would be reintroduced into the Lords first.

Under Lord Clement-Jones' proposals, if an automated decision affects social security benefits, immigration, or similar, a citizen would have a right to access the information on why the decision was made so that they could challenge it. The proposed bill says public authorities should publish impact assessments of any automated or AI algorithms they use to make decisions, and to keep a transparency register on automated decision making. It also obliges the government to provide an independent dispute resolution service for people who want to challenge any decisions made about them.

The CMA is currently monitoring developments in the fuel market using information provided voluntarily by fuel retailers. It has created a temporary price data-sharing scheme, and it is positive that some major players have started to integrate this into consumer-facing products, like apps. However, the current scheme covers only 40% of fuel retail sites and is not comprehensive enough to be utilised by map apps or sat-navs to bring accurate, live information to people – and this is what would have a substantial impact on the market.

The proposed introduction of the Digital Information and Smart Data Bill by the new government could provide the legislative basis to set up a compulsory and comprehensive scheme that would change this – which the CMA would welcome.

In a dramatic turn of events, a much hyped specific "AI Bill" was missing from the 40 policy bills set out in the briefing notes. This was particularly surprising given that the King's Speech itself referred to the Government seeking to "harness the power of artificial intelligence as we look to strengthen safety frameworks", as well as "establish the appropriate legislation to place requirements on those working to develop the most powerful artificial intelligence models".

Alternatively, the references in the King's Speech might, instead, allude to placing the existing AI Safety Institute on a statutory footing. Either way, it sounds like we will be kept guessing a little longer around the UK's approach to regulating AI. However, the current lack of detail risks fostering uncertainty, reducing confidence, and deterring investment in the UK market.
