纏訟16年！Intel歐盟反壟斷案上訴遭駁回但罰金「打六折」法院認定當年付錢要求HP、宏碁與聯想延後推出AMD處理器產品有違規行為 針對這樁長達16年、堪稱科技史上最漫長的歐盟反壟斷官司，Intel稍早再度遭遇挫折。根據路透新聞報導，Intel針對歐盟委員會 (European Commission) 先前開罰的3.76億歐元罰款裁決提出上訴宣告失敗，法院維持原判決中的違規認定，但裁定將罰款金額削減約三分之一，降為2.37億歐元 (約2.766億美元)。追溯至小筆電時代，「裸限制」條款成關鍵這起案件最早可追溯至2009年，當時行動運算剛起步，小筆電 (Netbooks) 仍是當時PC市場的主流產品。歐盟指控Intel在兩個層面違反了反壟斷法： • 利用非法的隱藏回扣 (hidden rebates) 將競爭對手排擠出PC處理器市場。 • 支付費用給製造商，要求其延遲或停止生產搭載AMD處理器的產品。此次判決主要針對的是第二點，也就是被稱為「裸限制」 (naked restrictions)的違規行為。裁決指出，Intel在2002年至2006年期間，曾向HP、宏碁及聯想等PC業者支付款項，以此限制競爭對手的發展。罰金從10億到2億，官司還沒結束？這場法律攻防戰在歐盟法院間來回拉鋸多年，Intel其實已經取得部分勝利：2022年，歐盟普通法院推翻了最初針對「隱藏回扣」部分的判決，隨後歐盟法院 (EU Court of Justice) 也在去年確認此結果，使得原本高達10.6億歐元 (約12億美元) 的罰單被撤銷。不過，針對「裸限制」部分的3.76億歐元罰款則在2023年被再次確立。Intel此次上訴原本希望能將這筆罰款也一併撤銷，但最終僅爭取到金額減免。即便此次判決似乎已為此案劃下句點，但根據歐盟法律程序，歐盟委員會與Intel雙方仍可針對法律觀點向歐盟最高法院提出上訴。

Chuwi's Minibook X N150 is a great (and inexpensive) little laptop The 11-inch MacBooks were compact, capable and good-looking. Discontinued in 2019, nothing similar's come along since from Apple, though rumors emerge now and again. I switched to Linux the first time because I got a new netbook and Windows 8 came stock. It couldn't actually handle the stock OS. I tried lubuntu, and eventually a friend got me to try Arch and I've been using it ever-since.
