Oxfam Italia interviene nel dibattito pubblico sul **referendum sulla giustizia** come sviluppo coerente dell’analisi contenuta nel Rapporto annuale 2026, “**Nel baratro della disuguaglianza. Come uscirne e prendersi cura della democrazia** ”. Il Rapporto evidenzia come la crescente concentrazione della ricchezza e del potere possa incidere sulla qualità delle istituzioni democratiche e sulla loro capacità di garantire diritti e pari opportunità. In questo quadro, **il mantenimento di un equilibrio effettivo tra i poteri dello Stato assume un rilievo centrale per la tutela della democrazia**. È a partire da questa analisi – e dalla necessità di prendersi cura della democrazia nel momento storico attuale – che Oxfam sviluppa la propria **riflessione sul passaggio referendario**. **Oxfam Italia interviene** non per entrare nel merito tecnico della riforma della giustizia, che non rientra nella propria specifica competenza e su cui si stanno già esprimendo altre voci autorevoli, ma **per offrire una chiave di lettura coerente con la propria missione** : il ruolo della giustizia come presidio essenziale dei diritti, dell’uguaglianza e della democrazia, in particolare per chi dispone di minori risorse e tutele. **Per Oxfam Italia la giustizia è un bene pubblico fondamentale e uno dei pilastri della democrazia** : è uno dei poteri dello Stato e svolge una funzione essenziale nel sistema di pesi e contrappesi previsto dalla Costituzione. Non è solo una materia tecnica, ma **una funzione centrale per assicurare la tutela dei diritti e l’uguaglianza davanti alla legge**. In un contesto segnato da una crescente concentrazione del potere economico e politico, **la tenuta dei rapporti tra i poteri dello Stato assume un rilievo particolare per la qualità della vita democratica**. Se questo bilanciamento si indebolisce o se la giustizia è esposta a pressioni esterne, i soggetti più forti possono disporre di maggiori risorse economiche e relazionali per tutelare i propri interessi, mentre le conseguenze ricadono più facilmente sulle persone che dispongono di meno mezzi, per le quali l’autonomia e l’imparzialità della giustizia rappresentano uno strumento essenziale di tutela dei diritti. È per queste ragioni che **Oxfam ritiene che la riforma, intervenendo su assetti che riguardano il rapporto tra i poteri dello Stato, possa comportare rischi per la qualità della democrazia** , per la giustizia intesa come bene pubblico e per le garanzie di chi dispone di minore potere economico, sociale e politico. Coerentemente con il proprio mandato, **Oxfam non assume una posizione di schieramento referendario ma richiama la responsabilità democratica di cittadine e cittadini** , invitando a informarsi, a comprendere cosa è in gioco e a esercitare il diritto di voto in modo consapevole, tenendo presente il valore della giustizia come bene pubblico e l’importanza del corretto bilanciamento tra i poteri dello Stato.
