Yesterday I filed an #AmicusCuriae brief at #SCOTUS in the birthright citizenship case. It presents stories of 3 families of Japanese ancestry--w/o legal allegiance to the USA--to show citizenship derives from birth on US soil, not parental loyalties.

This isn't about the merits of your argument; it's a preliminary legal hurdle determining whether you even have the right to bring your case before a court. Establishing standing requires demonstrating a direct and concrete harm resulting from the FERC decision, a demonstrable link between the decision and that harm (causation), and the potential for the court to provide a remedy. The challenge in FERC appeals stems from the agency's broad regulatory jurisdiction, which inherently impacts numerous stakeholders. While it’s common to argue that a FERC decision indirectly affects you, that’s often insufficient. Courts require a *direct* impact. The Supreme Court case *Association of Battery Recyclers v. EPA* solidified this stringent requirement, emphasizing concrete and particularized injury. To proactively avoid the "standing" obstacle, carefully consider potential harm during FERC proceedings. Got asked by guy with/mic, cameraman filming this morning at Carlsbad beach, near Pine on grass triangle, what was the meaning of ‘amicus curiae’, I replied I didn’t know, and when asked if I cared to take a guess, I said no, no clue. He said ‘sounds latin’ and I agreed. Was weird.
