Interessant ist daran ja, dass sich da ein #Judikaturkonflikt zwischen zwei Höchstgerichten auftut. Denn juristisch hat der #VfGH eigentlich nicht das #VGW sondern den #VwGH korrigiert, der das Wiener Verwaltungsgericht zuvor auf eine stärker "biologische" Linie verpflichtet hatte.
